PROCEDURAL NOTICE AND ORDER

SETTING PUBLIC HEARING

(Issued October 7, 2009)

 

Pursuant to the Wyoming Administrative Procedure Act, W.S. § 37-1-101, et seq., and the Wyoming Public Service Commission’s (Commission) Procedural Rules and Special Regulations, notice is hereby given that a public hearing in this matter shall commence Monday, November 30, 2009, at 9:00 a.m. in the Afton Civic Center located at 150 South Washington Street, Afton, Wyoming

 

1.         This matter came before the Commission pursuant to due notice at its open meeting of August 14, 2009.   Steve Mink, Commission Staff Attorney, presented a summary of several customer complaints regarding increases in water rates, water use restrictions, and service disconnections and related fees.  Joshua Smith and John Bowers appeared as counsel for the Company.

 

            2.         Based on information presented at the open meeting, the Commission, on its own motion, initiated a formal investigation of Nordic Ranches to determine whether the Company or any related company is a public utility subject to Commission regulation under W.S. § 37-2-112.

 

            3.         On August 21, 2009, the Commission issued a Notice and Order Setting Public Hearing (Notice) for September 15, 2009 in Afton, Wyoming, providing for an intervention, comment and protest period ending September 4, 2009.  The Notice was published once a week for two consecutive weeks in the Star Valley Independent in Afton, Wyoming.   The September 15, 2009 public hearing was vacated.    

           

            4.         This public hearing will be conducted in accordance with the Wyoming Administrative Procedure Act and the Commission’s Procedural Rules and Special Regulations.  All interested persons may appear and be heard, either in person or through counsel, as provided by Commission Rule.
