Docket No. 30013-GC-05-161 (Record No. 9957) In the matter of the complaint filing by James Trumbull against Montana Dakota Utilities Company requesting a formal hearing on the high cost of utility bills due to inaccurate meter reading, Commission to conduct hearing on Mr. Trumbull's request for hearing and MDU's Motion to Dismiss Complaint. 2. Docket Nos. 70043-TK-05-10 and 70000-TK-05-1132 (Record No. 9891) In the matter of the petition of Level 3 Communications, LLC, for arbitration of an interconnection agreement with Qwest Corporation. The parties will brief the Commission on procedural scheduling and a possible request for modification of the procedural schedule. Harry Ivey, Commission Advisory Staff (CAS), briefed the Commission on the agenda item, which will include an update on the status of negotiations on setting a procedural schedule. The parties requested approval of changes in the procedural schedule that had been negotiated, subject to the Commission’s availability. Mr. Ivey recommended approval of the schedule changes and said the parties hoped an agreement would be reached before the proposed hearing date. Deputy Chair Lewis moved [i] to continue the hearing currently scheduled for October 24-26, 2005, to December 12-14, 2005; to extend the reply testimony deadline to November 18, 2005; and [iii] to change the discovery deadline to November 21, 2005. Commissioner Byrnes seconded the motion, and Chairman Furtney concurred.

1. Docket No. 30009-41-GP-05 (Record No. 10113) Wyoming Gas Company seeks authorization to pass on in retail rates a gas commodity cost increase of $0.62070 per ccf. Wyoming Gas asks that the increase be effective for customer bills rendered on or after October 1, 2005. Luy Luong, Commission Advisory Staff (CAS), briefed the Commission on the request and presented a technical memo dated October 7, 2005. Dave Lucero, CAS, indicated that while there had been complaints submitted in writing; there had been no requests for formal hearing. Responding to Commission questions, Gordon Neumann explained that bills for the budget billing customers have already been adjusted to reflect anticipated prices, clarifying that the adjusted amounts do not reflect an actual rate change and were based on an anticipated October 1, 2005, approval date. When asked why the requested increase is so large, Mr. Neumann stated Wyoming Gas has no storage capacity and felt the company would be better in the current market to wait to see if a reduced-rate contract could be obtained at a later time. Current purchasing is being done on the spot-market with the proposed cost increase based on NYMEX market prices. Mr. Luong added that Wyoming Gas submits its tariff rates on an annual basis rather than a periodic rate adjustment request. Deputy Chair Lewis expressed concern regarding the practice of spot market purchasing. There were no further comments or questions. Mr. Luong recommended approval of the pass-on increase effective for bills rendered on and after November 1, 2005, rather than October 1, 2005, with a Notice and Order. Deputy Chair Lewis moved to grant authority to pass on the cost increase by Notice and Order effective for bills rendered on and after November 1, 2005. Commissioner Byrnes seconded the motion. Chairman Furtney concurred with the motion to approve the pass-on increase. He also expressed his concern with reliance on spot pricing, and he asked the company to review whether this is the best approach and advise the Commission.

2. Docket No. 10018-CR-05-12 (Record No. 9808) Big Horn County Electric Cooperative, Inc., seeks Commission approval for a rate increase of approximately 10% to all rate schedules for energy sales. Luy Luong, CAS, briefed the Commission on the requested rate increase and presented a technical memo dated October 7, 2005. Howard Robinson of Big Horn County Electric Co-op indicated the request would impact all Wyoming customers, making their base rates equal to rates for customers in Montana. Mr. Robinson stated the customers have been notified of the requested increase by mail. There were no further questions or comments. Mr. Luong recommended approval of the rate increase by Order only effective for usage on or after October 20, 2005. After further discussion between staff and the Commissioners, it was decided an immediate effective date would be more appropriate. Deputy Chair Lewis moved to approve the request for a rate increase to Wyoming customers by Order only effective for usage on or after October 13, 2005. Commissioner Byrnes seconded the motion, and Chairman Furtney concurred.

3. Docket No. 30016-38-GP-05 (Record No. 10094) Application of Pinedale Natural Gas, Inc., for authority to pass on a gas cost increase of $6.40 per dth through its commodity balancing account on an interim basis, with an effective date of October 13, 2005. Jess Bottom, CAS, briefed the Commission on the request and presented a technical memo dated October 11, 2005. He indicated that, based on the information submitted by Pinedale Natural Gas, it appears the calculated rate of return is 13.75%, greater than the authorized rate of 8.8%. Mr. Bottom further indicated this calculation has not yet been reviewed with Pinedale Natural Gas. There were no further questions or comments. Mr. Bottom recommended an interim approval for 30 days of the increase for usage on or after October 13, 2005. This would allow time to work with the company to determine the actual rate of return. He also recommended asking Pinedale Natural Gas to file a general rate application the first part of 2006 to recognize and adjust for any overcollection. Deputy Chair Lewis moved to grant authority to pass on a gas cost increase on an interim basis for usage on or after October 13, 2005, by Notice and Order. The motion also included a requirement for a report within 30 days to resolve questions on the company’s rate of return. Commissioner Byrnes seconded the motion, and Chairman Furtney concurred.

4. Docket No. 20000-EA-05-226 (Record No. 10015) In the joint application of MidAmerican Energy Holdings Company and PacifiCorp for approval of a reorganization of PacifiCorp as a wholly-owned subsidiary of MidAmerican. Consider the motions for admission pro hac vice of [i] Thomas J. Dougherty of Rothgerber, Johnson & Lyons LLP, and [ii] James K. Tarpey of Holland & Hart, LLP. Steve Oxley, Commission Chief Counsel, briefed the Commission on the motions for admission pro hac vice. Thomas Dougherty would be representing the Wyoming Infrastructure Authority, and Mr. Tarpey would represent Wyoming Industrial Electric Consumers, (WIEC) in the proceedings. There were no further questions or comments. Mr. Oxley recommended authorizing Orders to admit both attorneys pro hac vice to this proceeding. Deputy Chair Lewis moved to authorize Orders, effective immediately, to admit both attorneys pro hac vice to the proceeding. Commissioner Byrnes seconded the motion, and Chairman Furtney concurred.

5. Multiple Dockets – Discuss issuance of Orders to Show Cause to the following companies why their authority to provide public utility service in Wyoming should not be cancelled due to noncompliance with Wyoming Law.

1. Undocketed. Emergency appearance by Western Wireless/Alltel requesting a one-week extension on filing requirements under Eligible Telecommunications Carrier (ETC) Rules. Liz Zerga, counsel for Western Wireless and Alltel, appeared before the Commission to request a one-week extension on the filing for ETC designation. Harry Ivey, Commission Counsel, stated his opinion that granting the extension would do no harm to other parties and had no objections to the request. There were no further questions or comments. Mr. Ivey recommended granting the request for a seven-day extension to make compliance filings without public notice or notice to other parties. Deputy Chair Lewis moved to grant the request of Western Wireless/Alltel for a seven-day extension until Monday, October 31, 2005, without prior notice to other parties, to make its compliance filing. Commissioner Byrnes seconded the motion, and Chairman Furtney concurred.

Dave Lucero, Commission Counsel, added that some of the companies have completed electronic annual report filing and are missing only the oath and verification pages. A combined hearing date for the first week of December is requested. Mr. Lucero stated, if the companies have not complied with requirements or do not appear for the hearing, their certificates to operate in Wyoming will be cancelled. There were no further questions or comments. Deputy Chair Lewis moved to issue Orders to Show Cause to the companies as listed on the agenda of the Open Meeting of October 18, 2005, to show cause why their authority to provide services in Wyoming should not be cancelled. 1. Docket No. 10012-45-CT-05 (Record No. 10123) Lower Valley Energy, Inc., request for authority to implement a Net Metering Tariff. Don Biedermann, Commission Advisory Staff (CAS), briefed the Commission on the request and presented a technical memo dated October 13, 2005. Mr. Beidermann said the tariff would cover all Lower Valley Energy's territory, not just Jackson, and the tariff would be revised to reflect this. There were no further comments or questions. Mr. Biedermann recommended approval of the request by Notice and Order, effective November 1, 2005. Commissioner Byrnes moved to approve the request for authority to implement a Net Metering Tariff by Notice and Order, effective immediately, with a requirement for a revision to reflect the correct coverage area. Chairman Furtney seconded the motion.

2. Docket No 70042-TA-04-4 (Record No. 8961) Application of WWC Holding Co., Inc., d/b/a CellularOne for designation as an Eligible Telecommunications Carrier (ETC) in areas served by Qwest Communications Corporation; and

Docket No. 70042-TA-04-5 (Record No. 9256). Application of WWC Holding Co., Inc., d/b/a CellularOne for designation as an Eligible Telecommunications Carrier in Clark; Basin; Frannie; Greybull; Lovell; Tensleep; and Hamilton Dome Wire Centers. Commission to consider confirming its action taken without notice to the parties of October 18, 2005, granting WWC an additional seven (7) days until October 31, 2005, to comply with the Commission's September 23, 2005, order requiring certain compliance filings. Harry Ivey, CAS, explained these items were placed on the agenda to validate or confirm the action taken in the previous open meeting granting WWC Holding Co., Inc., a seven-day extension to file for designation as an ETC. There were no further comments or questions. Mr. Ivey recommended confirmation of approval of the extension. Commissioner Byrnes moved to reconfirm the actions of the October 18, 2005, Open Meeting allowing WWC Holding Co. a seven-day extension. Chairman Furtney seconded the motion.

There were no further comments or questions. Ms. Bales recommended issuing Orders to Show Cause to each company with a scheduled hearing date of December 8, 2005. Commissioner Byrnes moved to issue an Order for each of the listed companies to appear at the December 8, 2005, hearing and show cause why their authority should not be cancelled. Chairman Furtney seconded the motion.

5. Docket No. 70000-1169-TK-05 (Record No. 10179) Confidential retail telecommunications services contract filing by Qwest Corporation pursuant to W. S. § 37-15-204. Mike Korber, CAS, briefed the Commission, stating Qwest has negotiated a contract with a Wyoming company for its products and wishes the contract to be included in Qwest's confidential file with the PSC. There were no further comments or questions. Mr. Korber recommended placement of this contract in the confidential files with no rate-making implications at this time. Commissioner Byrnes moved to place the contract in the confidential files with no ratemaking implications. Chairman Furtney seconded the motion.

Docket No. 30018-24-GA-05 (Record No. 9975) Application of Lower Valley Energy, Inc., for a Certificate of Public Convenience and Necessity to investigate the feasibility of constructing a natural gas pipeline from the Merna Area, Sublette County, Wyoming, to serve in the Jackson, Wyoming, area. Commission to consider the Request for Intervention and Request for Hearing filed by Harmon Pfisterer and Pfisterer Family Limited Partnership. Andrea Richards, representing the Pfisterer Family, asked the Commission to consider only the Motion to Intervene and not consider the Request for Hearing at this time. She stated it is crucial that all issues be considered to determine the public interest and believes the Pfisterer Family is qualified to intervene. Bruce Asay, representing Lower Valley Energy, requested the Commission deny the Petition to Intervene and the Request for Hearing as the Certificate for Public Convenience and Necessity is for the greater good and in the public interest. There were no further comments or questions. Harry Ivey, Commission Advisory Staff (CAS), recommended the Commission grant the Request for Intervention and hold in abeyance the Request for Hearing. Deputy Chair Lewis moved to grant the Request for Intervention by Harmon Pfisterer and the Pfisterer Family Limited Partnership and hold the Request for Hearing in abeyance. Commissioner Byrnes seconded the motion, and Chairman Furtney concurred.

2. Docket 30018-26-GP-05 (Record No. 10183) Lower Valley Energy (LVE), Inc., request for authority to pass on a $0.9421 per hundred cubic feet increase in their wholesale propane rates. Don Biedermann, CAS, briefed the Commission on the request and presented a technical memo dated October 21, 2005. Mike McBride of Lower Valley Energy responded to questions from the Commission regarding the company's rate of return, the transfer of the propane customers to natural gas, and the necessity of filing a rate case. Mr. Biedermann stated this request for an increase does not affect the company's rate of return and is a dollar-for-dollar increase. There were no further comments or questions. Deputy Chair Lewis made a motion to grant the request for authority to pass on an increase in wholesale propane rates by Notice and Order, effective for usage on and after November 1, 2005. The motion was amended to include direction to LVE to advise the Commission within five working days from this date of the manner in which LVE will report its finances so the Commission can evaluate the rate of return and its impacts. Commissioner Byrnes seconded the motion, and Chairman Furtney concurred.

3. Docket No. 30018-25-GP-05 (Record No. 10182) Amended Application of Lower Valley Energy, Inc., for authority to pass on an increase in wholesale natural gas costs of $0.33 per therm, effective November 1, 2005. Jess Bottom, CAS, briefed the Commission on the application and presented a technical memo dated October 20, 2005. Mike McBride of LVE responded to Commission questions about hedging determinations and projected costs. There were no further comments or questions. Mr. Bottom recommended approval of the pass-on increase by Notice and Order, effective November 1, 2005. Deputy Chair Lewis moved to approve the application for authority to pass on an increase in wholesale natural gas costs by Notice and Order, effective November 1, 2005. Commissioner Byrnes seconded the motion, and Chairman Furtney concurred.

4. Docket No. 30011-45-GP-05 (Record No. 10107) Energy West Wyoming has filed for authority to pass on a gas increase of $5.4458 per Mcf for a base gas cost of $11.4952. Luy Luong, CAS, briefed the Commission and presented a technical memo dated October 21, 2005. Mr. Luong stated the company's rate of return is currently 9.03 percent, and the authorized rate is 9.33 percent. Brad Samuels and John Allen of Energy West responded to Commission questions regarding price hedging and differences in pricing between Montana and Wyoming operations. There were no further comments or questions. Mr. Luong recommended approval of the pass-on increase for usage on and after November 1, 2005 by Notice and Order. Deputy Chair Lewis moved to grant authority to pass on a gas cost increase by Notice and Order, effective for usage on and after November 1, 2005. Commissioner Byrnes seconded the motion, and Chairman Furtney concurred.

5. Docket 30013-164-GP-05 (Record 10186) Montana-Dakota Utilities Company request for authority to pass on a wholesale gas cost increase of $1.929 per decatherm. Don Biedermann, CAS, briefed the Commission on the request and presented a technical memo dated October 21, 2005. He stated this is a monthly pass-on request and represents a dollar-for-dollar increase for all customer classes with no increase in the company's rate of return. There were no further comments or questions. Mr. Biedermann recommended approval by Notice and Order effective for usage on and after November 1, 2005. Deputy Chair Lewis moved to grant authority to pass on a gas increase by Notice and Order, effective for usage on and after November 1, 2005,. Commissioner Byrnes seconded the motion, and Chairman Furtney concurred.

6. Docket Nos. 70009-243-TA-05 and 74645-2-TA-05 (Record No. 10067) Joint application of United Telephone Company of the West d/b/a Sprint, Sprint Long Distance, Inc., and Sprint Nextel Corporation for Authority to transfer control of United Telephone Company of the West d/b/a Sprint and Sprint Long Distance, Inc. from Sprint Nextel Corporation to LTD Holding Company. Art Schmidt, CAS, briefed the Commission and presented a technical memo dated October 17, 2005. He stated United Telephone Company of the West would be a separate entity with no change in rates, terms or conditions to customers in Wyoming. The official Notice period expired September 12, 2005, with no protests, comments or interventions. Ivan Williams, OCA, stated his office had reviewed the application and sees no necessity to intervene. There were no further comments or questions. Mr. Schmidt recommended approval of the application by Order only, effective immediately. Deputy Chair Lewis moved to grant the joint application for authority to transfer control by Order only, effective immediately. Commissioner Byrnes seconded the motion, and Chairman Furtney concurred.

7. Docket No. 10002-68-CS-05 (Record No. 10173) Carbon Power & Light, Inc., is petitioning for Commission authority to obtain a loan for $3.5 million from Rural Utilities Service for the purpose of constructing a new headquarters facility and increasing its perpetual line of credit with National Rural Utilities Cooperative Finance Corporation from $1 million to $2.5 million. Don Biedermann, CAS, briefed the Commission on the petition and presented a technical memo dated October 21, 2005. The new building will be used by the regulated utility and non-regulated businesses (Direct TV). Luy Luong, CAS, added the company will be using revenues from the Direct TV operations for collateral. There were no further comments or questions. Mr. Biedermann recommended the petition be granted by Order only, effective immediately. Deputy Chair Lewis moved to grant authority to Carbon Power & Light, Inc., to obtain a loan by Order only, effective immediately. Commissioner Byrnes seconded the motion, and Chairman Furtney concurred.

Docket No 90000-90-XR-03 (Record No 8712) Commission to consider adopting previously-noticed sections 241 and 504, of the Commission's Procedural Rules and Special Regulations regarding the payment of interest on customer deposits held by gas, electric, water and telephone utilities in the state of Wyoming.

Docket No 90000-92-XR-05 (Record No 9961) Commission to consider adopting previously-noticed sections 249 and 250 of the Commission's Procedural Rules and Special Regulations regarding utility wholesale commodity cost pass-through procedures.

This meeting was postponed until November 8, 2005.
